My buddy just got s-canned yesterday. They said it was "budget cuts". They also laid off another guy in editorial the same day.
Now, today...they hired the editor of a neighboring paper for news....rendering "budget cuts" a crock of ****.
Is there justifiable cause to sue for wrongful termination?

People throw lawsuit threats around all the time, but A) there appears to be no case here; and B) if there was a case, your buddy would have to hire a lawyer, wait a year or two, and pay tens of thousands of dollars to get back pay that would amount to less than legal fees. And at the end of that he'd get to return to what sounds like a crappy job.

He should just go **** on the publisher's windshield.

The answer is: It depends.

Mostly on your state.

Probably not, though, unless he's a minority, disabled, old, or a whistle blower.

Thanks for the answers...yeah, sounds hopeless.
Just really pissed off right now.

It's not unusual for a company to have layoffs and then hire others from outside to fill at least some of those jobs.

No.

doubtful but conceivable if some of those involved are members of a protected class - minority, elderly, female. if the two guys axed were black and they hired a white guy, it would raise eyebrows down at the local EEOC office.
