Maybe I missed it, but this story does seem to matter-of-factly declare the suspect a murderer without any mention of a trial.

Yeah. That. Among other things. If you're a journalist and don't see any issues with this story, you might need more training.

You're right. Under way should be two words.

AP changed its stylebook and now says one word in all uses, nautical or otherwise. My paper at the time immediately amended our stylebook to reaffirm the two-word standard except as a nautical modifier, as the AP rule was.
 
The story is just a bad transcription of the on-air story. Whoever did it forgot to include the "Police said." Doesn't fix it obviously, but does deliver the why and how.
