Man didn't father child, but won't get child support back

I know I've used that line.

 

I was thinking it is the mother who should be paying up. It sure seems like she knew all along who the father was. It sounds like she committed fraud to me, no matter what the poor guy's feelings for the son are.

Caring for the son is one thing. Having to take financial responsibility for him because the mother is full of shit is another matter entirely.

 

Any course of action would have to be a civil fraud claim against the mother, in my entirely uneducated legal opinion.

I believe this is where the guy runs up against a statute of limitations problem.

Interesting case, for sure.
