    Been thinking about this one a while. If I was Shannon's, I'd be a little nervous. I don't think the others have a worry.

    When I tended bar, it was HAMMERED into us that we were responsible for the actions of the people we served. We were ordered to cut off anyone without hesitation. We were ordered to find a manager when someone we thought was drunk was getting ready to leave.

    Shannon's offered him a cab. That's great. The people there saw how much he had to drink. They should have made him take a cab. Yes, made him. Any place that serves booze that doesn't employ someone strong enough to handle this job is asking for trouble. Part 2 of a bouncer's duty.

    moddy, you're exactly right but the article i read about the lawsuit mentioned that missouri has a statute specifically exempting establishments from liability for actions of their customers. so if that's the case, hancock's estate has no shot at winning against the bar unless they can somehow turn it into an involuntary intox case as contrasted with voluntary intox.

    From the Post-Dispatch Web site, moments ago:

    Missouri state alcohol regulators said this afternoon that they found no violations in the way Mike Shannon's downtown restaurant served drinks to Cardinals pitcher Josh Hancock the night he was killed in a DUI crash.

    The Division of Alcohol and Tobacco Control spent two weeks investigating whether anyone at Mike Shannon's Steaks and Seafood served a visibly intoxicated person, which would violate the law. At stake would be potential criminal prosecution, a fine or even license suspension or revocation.

    It said today it had found "no credible evidence" that anyone at Shannon's knowingly served someone who was intoxicated. It said no action would be taken against the restaurant.

    I'm guessing the tow truck company can countersue for a lot more than damages to a single truck. Possibly can point to some decline in their business as a result of the bad PR from having been involved in the death of a Cardinal and now this lawsuit.

    I wonder if Papa Hancock is going to sue the curb and the shrub that got in the way of drunken Lindsay Lohan's Mercedes.

    In there, it says Mike Shannon's wife died from brain cancer Saturday.
    Whether or not the 2 are related, who knows.
