Bus driver killed after swiping side mirror

    I'm glad it wasn't busdriver, tho not happy that someone died in that way.

    In most US jurisdictions, premeditation is not the difference between manslaughter and murder. It's the difference between first- and second-degree murder.

    First-degree murder = intent to kill + premeditation + killing

    Second-degree murder = intent to kill - premeditation + killing OR dangerous conduct + indifference toward human life + killing

    Voluntary manslaughter = intent to kill + killing + mitigating circumstance OR intent to harm + killing

    Involuntary manslaughter = killing - intent to harm

    It's not a difficult argument to make that this guys behavior amounts to indifference toward human life. The video shows a pretty brutal, albeit short, attack.

    A car is a tool. To value it like a family member is rampant narcissism.

    An expensive tool, sure. Fun to dress it up, sure. But c'mon ...

    The whole "malice aforethought" thing that Wikipedia article is talking about is the old English common law. In most places this scheme has been usurped by statutes, which often follow closely but aren't exactly the same. The Model Penal Code, which many states are slowly moving toward defines it as:
    Even under the MPC, I think this would be murder because it would be a killing committed recklessly with extreme indifference to the value of human life.
