    In the most significant wind vs. water debate here in Mississippi, State Farm lost when the judge said that the onus was on the company to prove what portion of damage was caused by wind and what was caused by water. The company said the water took it all away, so we don't have to pay. Judge ruled against the company, made them pay policy limits and gave the damages portion to the jury. Jury awarded $2.5 million; judge cut it to $1 million.

    Edit: Slappy, just realized my post doesn't really respond to your question which I quoted. The lawsuits revolve around the issue of wind vs. water. There's a secondary issue of many people not having flood insurance because they lived outside the flood zone. Many folks who actually tried to get it were told by their agents not to waste their money. That was a big reason for the grant programs, because the government told folks they didn't need flood insurance and they got socked.
