Slur about Dan Shaughnessy's wife

    Cute line, but Gordon Edes' curly-haired boyfriend is a pretty decent guy.

    Smasher, I ask this sincerely, how would that work in this case?

    Shaughnessy is a public figure and would have to prove actual malice. From my com law classes, good luck trying.

    It also could be argued the comment was parody, because Dr. Shaughnessy, his wife, would've known that the fornication didn't happen -- I don't know if that would fly, but the writer could try and hide behind Falwell v. Hustler on that one, I'd think.

    Truth is, there is no case at all.
    But, threatening suit, can be the endgame. Sicking lawyers often achieves intended result.
    You can sue anyone for anything. Doesn't mean you're going to win.
    In addition, "secondary libel" is even more difficult to litigate than the original offense.
