School sends lesbian to fake prom ...UPDATE: Lawsuit settled for $35,000

    Was $100,000 not a reasonable sum to shoot for?
    Damn, that's not very much money to settle for.
    With any decent lawyer on retainer, they seemed to have the "bad guys" by the balls in this one.
    Just seems like a pittance in a situation where they could have earned more for all the bullshit they had to endure.

    She may have just been interested in proving her point.

    But if there was ever a slam dunk opportunity to make it about the money this is the time.

    That's a pretty good settlement. Damages for a constitutional violation are so speculative it is impossible to tell what she might expect to get at trial. Chances are no Mississippi jury these days would sympathetic enough to a lesbian who missed the prom to the tune of six figures. Also, considering this is just 3 months after the incident, a bird in the hand is worth a good bit. The defense could drag this out over years with discovery, delays, trials, and appeals. $35,000 today without the hassle of trial and appeal is probably worth the equivalent of $100,000 a couple of years down the road.

    The whole incident was such a backslap to the state and its image.
    Being a Mississippian, it was sad to watch how it played out.
    I wonder if her lawyers were from the state, too.
