School sends lesbian to fake prom ...UPDATE: Lawsuit settled for $35,000

    Every year, there are a couple of stories about schools where the autistic kid at the end of the bench gets to make one basket, or carry once from scrimmage. The kid is as happy as if he'd won Powerball. But the other students are all a little aglow, too: "Hey, that was cool, and everybody was pulling for it."

    These people will never know that feeling.

    Discriminating on the basis of no one wants to be around an attention whore is an entirely different thing, though.

    A school district is not in the business of pulling a swerve or creating an outcast class. Heck, maybe the school should have gotten a few kids to harass her for the Massachusetts Solution to school pariahs.

    In the big picture, tho, this can't stand unacted upon; a possibly (possibly) frivolous suit is preferrable to suffering these kind of actions by a public entity in silence.

    The discrimination here is kids were excluded from a private - albeit school-sanctioned prom. The fact the "private" prom was announced by the district's lawyer is a BIG Ol' Hulking Red flag.
    I can't wait to see who sponsored the event. If any public or school money was used this a slam dunk.
    Don't know about there, but here school board members can be held personally liable for actions by the BOE.

    Wanna bet a BOE member's kid attended the "private prom."

    Regardless of how you feel about litigous teen lesbians, it's a bigger deal now. This is discrimination against students with special needs, an even more egregious offense.
    I don't want to see a court verdict bankrupt the town. I just hope the townspeople realize these elected bastards put their town's economic well being in serious jeopardy, and act accordingly.

    Other than being a lesbian?
    And what of the other kids who were also excluded?
    All she and the other kids need to prove is they were willfully excluded from a school-sanctioned event.

    How could she have sued prior? It is my understanding the school didn't ban her from the prom, they cancelled the whole damn thing .. for everybody.
    On what grounds do you think she could have sued?

    No.
    It would be like the separate but equal status, which was struck down....
    Doesn't matter whether homosexuality is a protected class. She can join the other kids to file a suit.
    There are grounds here.

    It did at the time, but it has been extended. And it would apply here IF the school is sponsoring a public and private prom.

    Because the school district should have foreseen the consequences of what would happen if they tricked kids into a separate prom. They didn't, and stupidity needs to be punished.

    If the taxpayers don't want to get hit with lawsuits, then they should have inudated the school with calls once the private prom was announced. They didn't, and thought they were putting one over on the 'different' girl.
