    OK, they were wrong. Being wrong alone does not constitute paying a settlement. And they also just said he was being investigated for it. Maybe he is -- that is certainly one question investigators are asking themselves, if an assault occurred.

    And as noted before, the Miami police even told someone that it was a sexual assault investigation.

    This is not something I should be explaining to you. This is something you should be explaining to the rest of us.

    Of course not. But if Kaepernick can make a plausible case that they wrecklessly disregarded the truth in reporting that he was being investigated for a sexual assault when he was not, and when no one told them that, then he could absolutely get a settlement out of that suit. Would he win in front of a jury? I don't know. Neither does TMZ, though. Which is why they would settle, like most defendants do.

    I think if you took five minutes to think about this case, you would realize there is no chance of success for Kaepernick.

    There is absolutely a chance of success for Colin Kaepernick to gain a settlement out of this case. (If, indeed, that is, he was not being investigated for sexual assault.)

    What's the motive for a media outlet to settle something it knows it wouldn't lose in court? Particularly when settling would do damage to its credibility?

    The motive is that it might lose in court.

    And that litigation is expensive. And that no one wants to have to do depositions and discovery and hang their dirty laundry out for the world to see.

    Lots of motives.
