    Whatever arguments Jeep makes that the product name is intended to reflect positive attributes: strength, dependability, etc etc, imply those attributes were well-known before the product was released.

    Jeep once set the tribe’s name free when they sold a redesigned Cherokee in the U.S. as the 2002 Jeep Liberty.

    Hey, it worked for Nike, Trek, and the US Postal Service when they sued Lance Armstrong!

    There are dozens of names that connote those things. Putting aside whether the name "Cherokee" is licensable, which I don't believe it is, they can change the name without losing any benefit. They lose the brand awareness they built up, but they'll do that if they need to make this go away because the bad PR is killing them.

    Or Jeep ponies up a little bit of money and does something that's seen as a huge PR victory on behalf of the Cherokee, and grows positive brand awareness.
