Therefore he'd have to take down two witnesses, not just one. Sure they were far from two suburban kids from Westchester Cty (hello Mike Tyson) but they still should be taken at their word until shown otherwise; they deserve that much. Sad.

The other issue at hand is whether or not the victim was willing to testify. Also in the original story it mentioned that the DA left in the endangerment charge in case they decided not to put the girl through reliving the experience by testifying in court. So that could be what held up the prosecution from proceeding with the more serious charges.

Her friend is also far from reliable as a witness or free from guilt in this situation as the one who talked her into going back up to the room, and I'm just guessing here, being that she is two years older, probably the one who talked her into going to New York in the first place.
