Found this while catching up on the latest Braves stadium idiocy. A policeman in Cobb County, one of 250 "certified drug recognition experts" in Georgia, is locking up people who have never smoked marijuana because he can "detect" that they're impaired.

So what does his department think of this?

Civil liberties. You probably weren't using them anyway.

That is a load of BS. Those people should have some recourse to at least recoup their expenses, lost wages, etc.

The 'investigative team,' though, should've pulled all 90 arrests and verified how many convictions, pleas and dismissals there were.

Sounds like "spectral evidence" has reared its ugly head again after disappearing from the landscape for 300+ years.

They'd probably end up committing crimes anyway, so it's good to get ahead of it.

If I dismiss three DUI charges from the same officer in as many months because the blood tests show they were false, I'm writing a letter to his commanding officer and demanding a sit down. I'm also contacting the state agency that certifies DREs.

This guy is being sloppy and as a result bringing the efficacy of the entire DRE program into question.

Drug impairment recognition can be nearly as effective at predicting drug impairment as the standard field sobriety tests are at predicting alcohol impairment. But just like the SFSTs, the whole protocol needs to be followed and in the right order. It's a much lengthier roadside test, but when done right it is effective.

The article glosses over the most important point about this guy. He was apparently taking shortcuts.

Yeah, but you're reasonable. Most judges aren't when it comes to the word of a cop.

Maybe I was too harsh. At least the Drug Whisperer wasn't whispering "We only kill black people."

A cop in Cobb County said that? No way.
