    It’s easy to understand why we try murders and other crimes - the conviction rates are high. No one consents to be shot or robbed or beaten. But evidence of sexual assault, in the majority of cases, is not different than evidence of consensual sex, a legal act. People argue that the default is to believe the accuser. They announce it with pride. They express outrage if you suggest it’s an open question whether Sepp Blatter has been accused of sexual assault. Anne Peterson even joyfully retweeted people proclaiming they believed Hope Solo. People continue to stand with Jackie.

    Rick points out that the rate of false accusation is about 2 percent, and most of those are unearthed during the initial investigation. Very few people would be wrongly convicted under my proposal. A lot of perpetrators would, on the other hand, face justice when they wouldn’t have in the past. They would not be free to victimize others.

    So why try these cases? Doesn’t my proposal better serve society?
