I think Dooley means no one should care about a Supreme Court judge's sexual orientation. Which of course they shouldn't.
If Obama had a mischievous bone in his body (he doesn't), he'd nominate Hillary. The Republican Senators would be torn between the outrage of their base and the institutional imperatives of dealing with a former colleague. That is to say, all Senators think all Senators are qualified to do anything.

Oh if this Kagan is indeed a lesbian, I think there's some... well, I wouldn't call it mischief... let's call it... intrigue?

We do know of a certain case that's making it's way up the system, don't we? Prop 8, anyone?

From what I'm reading, she may not be 'in the closet,' but she's not a gay activist, either.

Some gay/lesbian websites are saying she's not 'out,' but it could be that she's a longtime same sex partner that she's not exactly hiding, either.

IS there any hope that Obama will look for the smartest progressive candidate or will be subject to another wonderful story Matt Lauer and Catie Couric can flog for weeks.

The court absolutely needs someone who to counter the FoxNews Four: Thomas, Scalia, Alito and Roberts, right wing reactionary demagogues. And Sonia is a lightweight

Senators are going to be EXTREMELY reluctant to participate in the outing of a closeted gay/lesbian nominee for public office, because two can play at that game. Right, Lindsay?

Lindsay Graham? Really? Never heard that, but nothing would surprise me.

Didn't George HW Bush already appoint a gay man to the Supreme Court?

Hadn't seen this before, but Justice Stevens was at the game where Ruth, "called his shot".

Stevens is my favorite Supreme Court justice. I will miss him. I'd like to see Harold Coe nominated but I suspect it will be Elena Kagan. She will be okay, I guess.

I don't think Obama will be scared off by a fight at this point. It might actually be good politics to nominate a big time liberal powerhouse (if any still exist) - the cries of socialism, marxist et. al. have become (no pun intended) white noise. It might be good to burn off the last few gallons of tea party outrage before the fall elections.

    Are you outing Lindsay Graham?

On called shot there is a great story in New Yorker a few weeks back. Stevens keeps a framed scorecard in his office of game. He is a huge Cubs fan. Seems like a really cool guy that has lived a full rich life. In WWII Stevens was credited with helping to break the code that led to the downing of Japan's Admiral Yamamoto, which many say was a turning point of the war.

Have we outed J. Edgar Hoover yet? Seems overdue.

The heck with nominating Hillary, I'd like to see how the Senators (of both parties) react if he nominated William Jefferson Clinton for the court. It will never happen, but it would be fun to see the reaction.
