The only way this works is if the guy was at the median in the middle and Stallworth was worried he might walk into the road.

If the guy was in the road already, he had time to flash his lights, but not stop?

I wouldn't put too much faith on what anyone says to police right after a car wreck. After mine, which is just a minor in-town thing, I kept insisting I had turned in front of the guy and it was my fault, when in actuality he had flown through an intersection into me as I was going straight across.
