    I'm not saying that, but in a case that is racially charged don't you think that they would want to have a racially balanced jury?

    The area is around two-thirds white, one quarter African-American, with other racial groups averaging about 2-3 percent each. Then it's time to pick 16 people for a jury, and miracle beyond miracles 14 of them are white.

    If the white population truly is 2/3rds, given random selection we'd see 16-juror panels with 14+ whites about 6% of the time. With peremptory strikes and the like, such a jury becomes even more likely.

    And, we'd have to start with those eligible to serve on juries, and who show up for jury duty, too, right?

    If it's true that many African-Americans have a hard time getting an ID, they probably aren't going to get called for jury duty.

    And, I'd imagine various convictions might also make you ineligible.

    Just read that the court initially sent out 1,000 summonses, which gathered about 250 potential (and willing... or, at least didn't have an excuse) jurors. Egads. Is such a poor rate that common? Anyone?

    Exactly. The actual jury pool doesn't necessarily reflect the overall population.

    Huh?

    African-Americans are convicted of crimes at higher rates than whites.

    Ohio law says you can't serve on a jury if you've been convicted of a felony, unless you've had your voting rights restored.

    State of Ohio Restoration Statute

    Thus, can't we conclude that the overall pool of eligible jurors is more white than the overall population, making the racial makeup of this jury more likely than if we just made assumptions based on the overall population?

    Cross examination going on now. Wow this guy claims he was falling backwards below eye level of the bottom of the car door when he fired. Yet the bullet trajectory is downward.

    His explanation: "Well, I've got long arms."

    Prosecutor: "You're aware all of this is on video, right?" (Because the video shows he was clearly facing the guy was standing up and fired down.)

    Tensing: "I am."

    Judge asked the Debose family to be in court by 4 o'clock. The jury had asked a question earlier in the day and then went back into deliberations, but it looks like a decision maybe coming down. Hung jury?

    Nope. Jury wanted Some testimony repeated, deliberations will continue Friday morning.
