    If he can't pay child support, then it's on *him* to go to court and ask for a modification of child support. He has to show all his financials -- not you. Otherwise, he's in violation of the law.

    The only reason I can see not going after him, especially with a lawyer who works on contingency, is that your wife is afraid of him.

    This just doesn't seem fair to the girl.

    I would hate for a point to come in her life where she needs the money, and for her to think, "Mom and Dad just didn't go after my biological father for the money."
