    She writes his actions were “non-violent,” which is what threw me.

    “I am bound ‘by standards of fairness and consistency of treatment among players similarly situated.’ The NFL argues that consistency is not possible, because there are no similarly-situated players. By ignoring past decisions because none involve ‘similar’ conduct however, the NFL is not just equating violent conduct with non-violent conduct, but has elevated the importance of the latter without any substantial evidence to support its position.”

    That was in the context of whether or not a default 6-game suspension, as spelled out in the Personal Conduct Policy, was in play. The relevant passage in the PCP specifically points to "sexual assault involving physical force or committed against someone incapable of giving consent." So the PCP, which you could call her "charter," had made it a point to distinguish "violent" from "non-violent" (her words) sexual assault with regards to certain automatic penalties. You (or others) may rightly say that violence isn't necessary for sexual assault to have occurred, but that's really neither here nor there with regards to that portion of her ruling.

    I'm with @qtlaw here ... the judge did the best she could with what she had to work with.

    Wait, the Dolphins penalty was for tampering and not Ross asking Flores to tank?

    Just in case anybody wasn't sure that Haslem was a piece of shit, he decided to make it clear for them.

    Yup. And the league has some of its media apologists pushing the narrative that they were some of the most blatant examples of tampering ever while they try to push the tanking thing under the rug. It is important to note that Ross actually did tell Flores that the teams should prioritize draft position over winning games. The league is claiming that no action was warranted because nobody took the comment seriously and Flores ignored it and led the team to some wins. Goodell said something about such comments being inappropriate, even if meant as a joke, because they could compromise the integrity of the game. That just seems like a half-hearted warning to league owners, executives, and coaches not to say stuff like that while at the same time, floating the idea that Ross was only kidding. Of course, that's bullshit. Maybe Ross didn't force the matter, but does anybody doubt that he meant it? The league can't admit that because it does undermine the integrity of the game. How do you allow Ross to stay the owner if you admit that he meant it?
