    And any nominee that doesn’t get a vote will be automatically assumed to be so absolutely qualified for the job that a Senate vote isn’t necessary and will be duly appointed.

    Not sure how that is possible when Constitution requires advice and consent.

    Anyone he wants who doesn't get confirmed will be named "acting" until Biden deems otherwise.

    Sure. But, as far as I know, other than treaties, there isn’t a provision for a required Senate vote.

    So, if there’s no vote, President Biden says “the Senate has advised that there won’t be a vote on Nominee X. Therefore, we will interpret that non-vote as Nominee X is so wonderfully qualified for this position that a vote is not necessary and that the Senate’s non-vote is their consent.”

    Let the courts sort it out.

    Where does it say in the Constitution that a cabinet member must be approved by the Senate by a vote? Advise and consent. Ask for advise. Appoint. Take office and force the Senate to act. Failure to act is consent. Like every good Christian Conservative and rapist knows, silence is consent

    The cabinet isn't addressed in the Constitution. Fuck the Senate.

    It does reference "public ministers and consuls" .... but textualism ... doesn't say "cabinet."
