Today in cops gone feral

    The truck driver was also a cop in another jurisdiction. They wanted his blood to prove he was clean and that impairment on his part did not contribute to the fatal crash. Because he was not considered a suspect in any way, they could not possibly get a search warrant because they had no probable cause that he had done anything wrong.

    That first part is probably what Payne will lean on in a feeble defense of this.
    "That was my brother, man! What would you do if you saw your brother laying there like that? Huh? HUH!?"

    And I do get the rationale behind it, I guess. Even if the truck driver wasn't a cop, it could protect him on a number of levels. I even get the frustration of being told "no" for what can feel like silly bureaucracy by a mid-level employee. I think we've all been there when trying to chase down a phone number for someone and a secretary stonewalls us because they can.
    It's still stupid. Silly bureaucracy is kind of what cops have to live by.

    Not being able to take blood from unconscious people doesn't qualify as "silly bureaucracy" for me, but I'm a socialist.

    That silly bureaucracy is better known as the United States Constitution and associated court rulings. The hospital didn't just make up that policy. It's settled law.

    I think you are too charitable with that cop, even though I mostly agree with what you said. This isn't a bureaucratic issue. It's the law! If the cops wanted his blood, they needed probable cause and had to make an arrest. ... or they needed to get a warrant. That is how it works in this country. The hospital "policy" is beside the point, because the policy was just a regurgitation of the fourth amendment.

    What infuriated me watching the video this morning was that the bully cop act. We don't all live under the authority of the police, the way he was acting. They can't order someone to do something that violates the rights of someone else just because they are the police -- that doesn't just go for an emergency room nurse, it goes for any of us. Let's say it is a landlord and the cops come to him and order him to open the door of a tenant for them, but they have no warrant. It's an unlawful order. It may get you roughed up or in jail on a BS charge by an out-of-control cop, but for me it's a virtue to disobey an order that you know is unlawful. In her case, she was really polite and tried to explain why under the law she wasn't required to comply with his draw blood order. That cop should be fired. And that nurse was heroic.

    I'm seeing a lot of that these days. Especially when the middlin' types aren't shown the proper respect.
