    Last Supreme Court opening during an election year was in 1968, when Arthur Goldberg resigned to become Ambassador to the United Nations after Adlai Stevenson died.

    President Johnson tried to move Abe Fortas up to chief justice, but the nomination was filibustered. Johnson's nominee for the vacancy was Homer Thornberry, who took Johnson's seat in Congress when LBJ was elected to the Senate. When Fortas' nomination was withdrawn, Thornberry had nowhere to go.

    Warren Burger was confirmed the following year after being nominated by Nixon.

    Yup. Obama could nominate Robert Bork and they'd block him. And yes, I know he's dead. You know what I meant.
