Patrick Kane rape investigation dropped by DA

    Patrick Kane will not be prosecuted on rape allegations; DA cites lack of proof - The Buffalo News

    “The totality of the credible evidence – the proof – does not sufficiently substantiate the complainant’s allegation that she was raped by Patrick Kane and this so-called “case” is rife with reasonable doubt,” Sedita wrote in a statement released Thursday. “Accordingly, the Office of the Erie County District Attorney will not present this matter to an Erie County Grand Jury.”

    That's pretty strong, on the DA's part.

    This is not a case of the DA just not having enough evidence to proceed.

    He clearly doesn't think this happened.

    The investigation found:

    • “Significant material inconsistencies” between what the alleged victim and those of other witnesses.

    • DNA tests conducted on samples taken as part of a forensic sexual assault examination at a hospital “lend no corroboration whatsoever to the complainant’s claim of penetration, a required element of proof for a rape charge.”

    • Physical evidence and forensic evidence “tend to contradict the complainant’s claim that she was raped on Kane’s bed.”

    • Sedita wrote: “Although Kane has exercised his constitutional right to remain silent (which prohibits questioning by law enforcement), he has made no known incriminating statements to any civilian, nor has he engaged in any conduct consistent with a consciousness of guilt.”

    Wait - was he ever charged? Were charges dismissed or just not filed?

    It may not be over, but there will always be people who are convinced he is a rapist. You think that's no thang, and I believe you have said so about the Duke lacrosse team and others falsely accused, including the UVA "frat bros." The "real victims," I think you called them, derisively, well after Jackie's story had fallen apparent.

    I happen to disagree.

    What "people?" Regardless of what anyone believes, it has not, and will not, stop him from living a life of privilege that only a select few of us ever get to live. He will not spend a millisecond in prison. Justice has been served. Just like it was in the Duke lacrosse incident.

    Someone accuses someone else of a crime. Police investigate it. If they find evidence, they charge. If not, they don't.

    He's been damaged considerably. Should we just shrug and say, Oh well, we don't really like that guy, anyway?

    He's been publicly trashed for a period of 2-3 months by local and national media, print and broadcast, on the basis of a false accusation that was wrongfully leaked. He has been damaged considerably.

    Of course he has. He lost his deal with EA sports and who knows how many other opportunities because there will always doubt in some people's minds.

    What's the financial cut off where your reputation doesn't matter?
